This Acceptable Use Policy ("AUP") applies to all hosting, email, server and network services supplied by Zomex. It forms part of our Terms of Service. You are responsible for ensuring that anyone who uses your account or services complies with this policy.

You must use our services lawfully, responsibly and in a way that does not harm Zomex, our infrastructure, our suppliers or other customers. A breach may result in content removal, service restriction, suspension or termination, depending on the seriousness and urgency of the issue.

Responsible Use

Shared hosting and related services are intended for genuine websites, applications and email use that is appropriate for the plan purchased. You must not use a service primarily as a remote backup, file archive, public download mirror or general-purpose storage platform unless the service is specifically sold for that purpose.

You must stay within the storage, bandwidth, account, database, email and other limits shown for your plan. Features described as unlimited are subject to the overall resources and fair-use limits of the service and must not be used in a way that adversely affects other customers.

Prohibited Content And Services

You must not store, publish, promote, transmit or link to content or services that:

  • are unlawful, fraudulent, deceptive or intended to facilitate unlawful activity
  • contain child sexual abuse material or exploit, endanger or sexualise children
  • contain pornography or operate adult services prohibited by the applicable hosting plan
  • incite violence, terrorism, hatred, harassment or credible threats
  • infringe copyright, trade marks, privacy, confidentiality or other rights
  • distribute malware, ransomware, spyware, phishing pages, credential-stealing tools or malicious code
  • promote illegal drugs, illegal gambling, unlawful weapons trading, pyramid schemes or fraudulent investment schemes
  • operate warez, cracking, serial-key, unauthorised streaming or pirated-download services
  • expose personal data without a lawful basis or otherwise breach applicable data protection law
  • are likely to cause material harm to Zomex, our reputation, our network or another person

Server And Resource Usage

You must not use excessive CPU, memory, disk input/output, database connections, processes or other shared resources. We may restrict or suspend a process or account that creates instability, degrades service for others or exceeds the reasonable capabilities of the purchased plan.

Unless expressly included with your service, you must not:

  • run cryptocurrency mining, distributed-computing or similarly intensive workloads
  • run game servers, IRC services, bots, daemons or persistent unattended processes
  • operate public proxy, VPN, file-sharing, peer-to-peer or torrent services
  • run scraping, crawling or automated activity that creates unreasonable load
  • circumvent quotas, technical restrictions, rate limits or security controls

Where practical, we will contact you and allow an opportunity to resolve excessive usage. Immediate action may be taken where necessary to protect the service, investigate abuse or respond to a security incident.

Bandwidth And Storage

Bandwidth and storage allowances are determined by your plan and normally reset or renew according to its billing cycle. Unused allowances do not carry forward unless stated otherwise. If you exceed an allowance, we may restrict the service, request an upgrade or apply an agreed additional charge.

Email accounts, subdomains, FTP accounts, databases and similar features remain subject to your plan's storage and resource limits. Large mailboxes or excessive numbers of files may affect performance and may need to be reduced or reorganised.

Email And Messaging

You must not send spam, unsolicited bulk email, mail bombs, deceptive messages or email that hides or falsifies its source. Marketing email must be sent only where you have a lawful basis and must include a clear and effective way for recipients to opt out.

You must comply with applicable email and privacy laws, maintain evidence of consent where required, honour suppression requests and keep mailing lists secure. Hourly or daily sending limits may apply and can vary by server or service.

This policy also applies where another provider is used to send messages that advertise or direct recipients to a website hosted by Zomex.

Security And Software Maintenance

You are responsible for maintaining secure passwords, restricting account access, keeping contact details current and protecting login credentials, API keys and recovery information.

You must keep websites, scripts, plugins, themes and other software reasonably up to date. We may disable vulnerable, compromised or abandoned software where it presents a risk to the account, server or wider network.

Network Abuse

You must not attempt to gain unauthorised access to any account, device, system or network. Prohibited activity includes vulnerability scanning without permission, password attacks, packet spoofing, traffic interception, denial-of-service attacks, flooding, exploitation and attempts to bypass authentication or security controls.

Copyright And Intellectual Property

You must have all licences, permissions and rights required for content stored or distributed through your service. We may remove or restrict access to material following a credible infringement complaint and may terminate repeat infringers.

Backups

You must maintain your own current, tested and independent backups. Any backup or restore feature provided by Zomex is supplementary and is not a substitute for your own backup arrangements.

Investigations And Enforcement

We may investigate suspected breaches and request information or corrective action. We may preserve or disclose relevant information where required by law, a valid legal process, a regulator, a court or where reasonably necessary to protect rights, safety or service security.

Depending on the circumstances, action may include a warning, removal of content, limiting resources, temporary suspension or termination. Serious or urgent breaches may be acted on without advance notice. Refunds following enforcement are governed by our Terms of Service and applicable law.

Changes To This Policy

We may update this AUP to reflect changes to our services, security requirements, supplier rules or applicable law. Material changes will be published on this page and will apply from the stated effective date.
